1. These terms of use (the “Terms of use”) govern your use of website https://doglicious.in (the “Website”) and our application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as the “Platform”. The Platform is owned and operated by Petlicious Superfoods India Private Limited (Hereinafter “Petlicious”, “Company”, “we”, “us” or “our”), a private limited company incorporated under the Companies Act, 2014 and having its registered office at Flat No. 601/1, Tarika Apartments, GH-08, Sector-43, Gurugram, Haryana-122001. For the purpose of these Terms of Use, wherever the context requires, “You”, “user”, or “User” shall mean any natural or legal person who shall transaction on the Platform by providing registration data while registering on the Platform as a registered user using any computer system.
2. Please read these Terms of Use carefully before you use the services. If you do not agree to these Terms of Use, you may not use the services on the Platform, and we request you to uninstall the App. By installing, downloading or even merely using the Platform, you shall be contracting with Petlicious and you signify your acceptance to this Terms of Use and other Petlicious policies (including but not limited to Cancellation and Refund Policy, Privacy Policy and TAKE DOWN POLICY) as posted on the Platform and amended from time to time, which takes effect on the date on which you download, install or use the Platform, and create a legally binding arrangement to abide by the same.
3. Registration
4. Any contract for the supply of goods and services from this Platform is between you and Petlicious. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of Registering. You also warrant that you shall update the requisite information of your account as and when it changes. You also warrant that the credit or debit card details that you provide are of your own credit or debit card and that you have sufficient funds to make the payment.
5. When registering on the Platform you may be required to provide an e-mail address and password. You must ensure that you keep the combination of these details secure and do not provide this information to a third party. In case you think that your account has been accessed by third person then you are advised to change your password immediately.
6. We will take all reasonable care, in so far as it is in our power to do so, to keep your details secure. In the event of any unforeseen event where the details of the User is compromised due to external factor then we cannot be held liable for any loss you may suffer from such unauthorized access by a third party.
7. Eligibility
   • This Platform is open for all ages however, for persons younger than 18 years old, the use of any of our services and website is only allowed with the valid consent of a parent or a guardian. We understand that you may need to provide us with information belonging to persons younger than 18 years old so as to avail our services, however, you do so at your own legal risk and in such a scenario, the responsibility to seek a valid consent from a guardian or a parent shall lie upon you and Petlicious disclaims any and all liability arising from the data/information provided in such an event and you shall indemnify Petlicious for the same.
8. Prices and Payment

• All prices for delivery by us listed on the Platform are correct at the time of publication; however, we reserve the right to alter these in the future.

• Petlicious reserves the right to alter/change the prices of the product and services, delivery charges, taxes (as applicable) etc., from time to time.

• Petlicious ensures in taking every possible precaution in protecting its Users’ personal information. The information of the payment mode of the User is collected by payment partner we may choose from time to time. However, it is advised that User should not save its payment details in order to avoid any misuse of such information. Such information is governed by payment partner’s own Terms of Use. We advise User to go through the same. Petlicious has no responsibility or liability for an improper use of any information relating to the usage of any payment information used by the User. If the User have any query regarding the security of their Personal Information provided to Petlicious, the Users are free to contact us at the given address on the Website.
• Promotional discount
  • We may offer promotional discounts codes that are applicable on the purchases made on the website. These discount codes can be applicable on all or certain specified products. Please note that use of only one discount code is permissible per order. You cannot use a discount code if an order is already placed.

• You shall be responsible for payment of all fees/costs/charges associated with the purchase of products from us and you agree to bear any and all applicable taxes including but not limited to GST, duties and cesses etc.
• Food Safety Standards and Protocols
• We take utmost care in sourcing Our ingredients used for making meals. Our food is freshly cooked with high quality ingredients. The quality of our food is Human grade.
• All Our recipes are curated by International Dog Nutritionist – Cam Wimble, London, UK. These receipies are curated keeping in mind the years of experience our Dog Nutritionist have gathered by serving thousand of proud parents of pets.
• We maintain all safety precautions & hygiene standards while preparing the food and take utmost precautions to adhere to all the hygiene prescribed standards to make the meals. However, in case there is any particle/substance found in the meal then User is required to immediately report the same so that required measures can be taken.
• We advise you to consult your Vet to discuss your pets food habits & allergies, if any before you subscribe us.
• Delivery
• Delivery timings quoted on the Platform are approximate and may vary based on factors such as distance, total order amount, traffic and weather conditions. The food items you ordered for will be delivered to the address designated by you at the time of registration.
• All orders are delivered by our own delivery network or any other reputed delivery service that we may choose to use from time to time. If the Goods are not delivered within the estimated delivery time quoted by us, please contact us by writing to us at gaurav.chandra@doglicious.in and we do our best to ensure that you receive your order as quickly as possible.

• If you fail to accept your food when it is out for delivery, or if we are unable to deliver at the stated time due to your failure to provide appropriate instructions, or authorizations, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass on to you.

• You must ensure that at the time of delivery of your order adequate arrangements, including access where necessary, are in place for the timely delivery of your order.

• We will try our best to deliver the product to you at the place of delivery as requested by you in your order within the time confirmed. We will inform you if we are unable to meet the estimated delivery time.

• Petlicious shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

• Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you register on our Platform and arrange for cancellation of the subscription or delivery to an alternative address.

• Wewill not be held responsible for any cessation, interruption or delay in the performance of its obligation due to earthquake, flood fire, storm, natural disaster, act of God, war, terrorism, pandemic, lockdown conditions, armed conflict, labor strike, lockout or boycott, or any such circumstances that renders it physically impossible for us to complete our obligation.

• Cancellation and Refund
• You must notify us immediately if you decide to cancel your order, preferably by phone. All cancellation should be communicated 24 hrs prior.
• We will not accept any cancellation requests after the cut off period.
• We may cancel an order if the product is not available for reasons that are not within our control. We will notify you if this is the case and return any payment that you have made.
• If the cancellation was made in time, we will refund to your payment source account or credit the said amount in User’s Petlicious wallet at the end of the month.
  • In the unlikely event that we deliver a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item provided you adhere to our process and procedure to verify the wrong delivery.  

• In case of the unlikely event of a failed delivery due to reasons beyond the control of the customer, Petlicious may adjust the amount paid by you for that period and extent it in subscription. In case of one time delivery of food we shall refund you the said amount in your source account or in your Petlicious wallet.

1. Feedback

1. Petlicious reserves the right to publish, or un-publish any feedback received from its customers on its website or app and the users provides the right to company to use the details of the user for publishing such feedbacks such as name, photo, star rating, details of the pet, feedback, etc.

1. Information

1. You agree to provide us with accurate and complete information wherever and whenever we have requested information to provide delivery.

1. You authorize us to use, store or otherwise process your personal information in order to enable the delivery of food items to you. These purposes may include the disclosure of your personal information to selected third parties from time to time where we believe that the services offered by such third parties may be of interest to you or where this is required by law or in order to provide delivery of food items.

1. Links to other sites

1. This Platform usually do not contain any third party links. In case due to any technical error you are shown any third party link on the Website/App then kindly inform the same to us at Woof@doglicious.in. Petlicious is not responsible in case you choose to click on such links and are routed to any third party website.

1. Limitation of Liability

1. Great care has been taken to ensure that the information available on this Platform is correct and error free. We apologize for any errors or omissions that may occur. We cannot warrant that use of the Platform will be error-free or fit for purpose, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Platform and we do not make any warranty whatsoever, whether express or implied, relating to fitness for purpose, or accuracy.

1. By accepting these terms of use, you agree to relieve us from any liability whatsoever arising from your use of information from any third party, or your use of any third party Platform, or your consumption of any food or beverages ordered from us.

1. We disclaim any and all liability to you for the supply of the food items to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for the relevant items. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits to you, howsoever arising.

1. We do not accept any liability for any delays, failures, errors or omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our Platform.

1. We shall not be held liable for any failure or delay in delivering food items where such failure arises as a result of any act or omission of you the user, which is outside our reasonable control such as all overwhelming and unpreventable events caused directly and exclusively by forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to: war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties.

1. If we have contracted to provide identical or similar order to more than one customer and are prevented from fully meeting our obligations to you by reason of an event of force majeure, we may decide at our absolute discretion which orders we will fill and to what extent.

1. We have taken all reasonable steps to prevent Internet fraud and ensure that any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties we use services of.

1. In the event Petlicious has a reasonable belief that there exists an abuse of vouchers and/or discount codes or in suspected instances of fraud, Petlicious may cause the shopper (or customer) to be blocked immediately and reserves the right to refuse future service. Additionally, should there exist an abuse of vouchers or discount codes, Petlicious reserves the right to seek compensation from any and all violators.

1. Disclaimer

1. We will do everything in our capacity to maintain the quality of food supplied and we list the ingredients used in making of food.

1. In an event of poor quality of food reported by a customer, Petlicious will take the majority opinion of the customers to whom the same food was delivered on the given day. If widespread quality issue exists, we will consider the issue and handle it accordingly.

1. Also, if your pet is allergic to any of the ingredients in the food it is your responsibility to check it and share this information with us. We will not be held liable if your pet faces any sort of health issues after consuming the food in case you failed to check, and something happened to your pet.

1. Cessation of operation

1. Petliciousmay at any time, in its sole discretion and without advance notice, stop the operation of the Website and/or distribution of the products and/or the offers provided on the website.

1. General

1. All prices are in indicated in INR. Prices are inclusive of taxes unless otherwise indicated

1. Any goods and services purchased from this Platform are intended for your use only and not for resale.

1. We may subcontract any part or parts of the product catalogue that we provide to you from time to time and we may assign or negate any part or parts of our rights under these terms and conditions without your consent or any requirement to notify you.

1. We may alter or vary the terms and conditions at any time without notice to you. You are required to accept the updated terms and conditions as soon as it is notified. In case of non-adherence, we may stop our services and resume them at time you accept our services.

1. It may be noted by the customer that unless once registered he/she will be receiving all kinds of promotional SMS, mails and notifications to keep him/her updated with our offers and other forms of information You may choose from time to time.

1. The terms and conditions together with the privacy policy, any order form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this agreement. In the event of any conflict between these terms and conditions and any other term or provision on the Platform, these terms and conditions shall prevail.

1. If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.

1. No delay or failure on our part to enforce our rights or remedies under the agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.

1. Merger and acquisition

1. In the event that Petlicious is acquired by or merged with third party entity We reserves the right, in any of these circumstances, to transfer or assign the information Petlicious has collected from its Users as part of such merger, acquisition, sale or other change of control.

1. Jurisdiction
   1. These terms and conditions and a contract (and all non-contractual obligations arising out of or connected to them) shall be governed and construed in accordance with Indian laws. Both, we and you hereby submit to the exclusive jurisdiction of the courts of Delhi. All dealings, correspondence and contacts between us shall be made or conducted in the English language.

1. Indemnification
   1. You agree to indemnify, defend and hold harmless Petlicious and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
